Gondwana is committed to respecting your privacy and protecting your personal data in compliance with data privacy legislation, particularly the (EU) 2016/679 General Data Protection Regulation (GDPR) of the European Parliament and of the Council of 27 April 2016 on the protection of individuals regarding the processing of personal data. This privacy policy outlines how we handle your personal data when you subscribe to our products or services (the “Application”) and informs you about your privacy rights and the legal protections available to you.
This privacy policy is structured to allow you to click through to specific areas set out below. It applies to the personal data collected for managing the Contract you signed to use the Application. This policy does not cover the personal data we process on your behalf in the course of delivering our products and services to you.
This policy explains the basis on which any personal data we collect from you, or that you provide to us for managing the Contract, will be processed by us. Please read the following carefully to understand our practices regarding your personal data and how we will treat it.

Gondwana is the data controller and is referred to in this privacy policy as “Gondwana”, “we”, “us”, or “our”.

6. The Data We Collect About You
Depending on your level of interaction with our website or the Application, we may collect, use, store, and transfer different types of personal data about you, including:
Identity Data: This includes your first name, last name, username or similar identifier, and position. This information is provided by you when you subscribe to our Application.
Contact Data: This includes your email address and may also include contact data within your organization when you are about to enter or have entered into a Contract with us. We require this information to manage the Contract and to facilitate communication with you. Additionally, we collect this data to comply with regulatory and legal obligations.
Technical Data: In relation to the use of the Application, this includes your internet protocol (IP) address, login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access the Application.
Usage Data: This includes details of your use of the Application such as traffic data, other communication data, the resources you access, and the number of active users of our Application. We collect this data to monitor and measure the performance of the Application and to manage the Contract.
We also collect, use, and share Aggregated Data such as statistical data for various purposes. Aggregated Data could be derived from your personal data but is not considered personal data by law as it does not directly or indirectly reveal your identity. For instance, we may aggregate your Usage Data to calculate the percentage of users accessing a specific feature of the Application or to determine the frequency of use of the Application. However, if we combine or connect Aggregated Data with your personal data in a way that could directly or indirectly identify you, we treat the combined data as personal data, which will be used in accordance with this privacy policy.
7. How Is Your Personal Data Collected?
Most of the personal data we process about you is provided by you, for example, when entering into a Contract for the use of our Application. The provision of such information is voluntary, but if you cannot provide it, you may not be able to use the Application effectively.
We will automatically collect personal data, including Technical Data and Usage Data, each time you use the Application. This data is collected using cookies and other similar technologies. We use cookies and other tracking technologies to distinguish you from other users of the Application and to remember your preferences. This helps us to provide you with a better experience when you use the Application and also allows us to improve the Application. 9. How We Use Your Personal Data
We will only use your personal data when the law allows us to do so. Most commonly, we will use your personal data in the following circumstances:
– With Your Consent: Processing your personal data where you have given clear consent for a specific purpose. Consent must be freely given, specific, informed, and unambiguous. You can withdraw your consent at any time by contacting us.
– To Perform a Contract: Processing your data where necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.
– For Legitimate Interests: Processing is necessary for our legitimate interests (or those of a third party) provided that your interests and fundamental rights do not override those interests. Legitimate Interest means our business interest in managing and conducting our business to provide you with the best service/product and the most secure experience. We ensure that we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests.
– To Comply with a Legal Obligation: Processing your personal data where necessary for compliance with a legal obligation to which we are subject.

10. Disclosures of Your Personal Data
To achieve the above purposes, we may need to share your personal data with the following third parties:
– Our Service Providers: Acting as our processors, including:
– Google Ireland Limited, which provides data hosting services related to the Application.
– Other suppliers appointed from time to time to provide various services, such as IT and system administration.
– Professional Advisers: Acting as processors or joint controllers, including lawyers, bankers, auditors, and insurers providing consultancy, banking, legal, insurance, and accounting services.
– Regulators and Other Authorities: Acting as processors or joint controllers who require reporting of processing activities in certain circumstances.
We only allow our service providers to handle your personal data if we are satisfied that they take appropriate measures to protect it. We also impose contractual obligations on service providers to ensure they can only use your personal information to provide services to us and not for any other purposes.
We may disclose and exchange information with law enforcement agencies and regulatory bodies to comply with our legal and regulatory obligations.
11. Data Security
All information you provide to us is stored on our secure servers. Where we have given you (or you have chosen) a password that enables you to access certain parts of our Application, you are responsible for keeping this password confidential. Please do not share your password with anyone.
Once we have received your information, we will use strict procedures and security features to try to prevent your personal data from being accidentally lost, used, or accessed in an unauthorized way.
We have implemented procedures to deal with any suspected personal data breach and will notify you and any applicable regulator where we are legally required to do so.
Your data is typically not processed or transferred outside the European Union. However, if personal information is transferred outside the European Union, Gondwana will ensure that the third country concerned has an adequate level of protection as deemed by the European Commission in respect of European regulation (GDPR). When this is not the case, Gondwana will ensure that the transfer is carried out in accordance with the Standard Contractual Clauses (SCC) adopted by the European Commission to guarantee the protection of this information.
We do transfer certain Aggregated Data to the USA (which does not contain any personal data) to help us improve our services to you and other users of the Application.
12. Data Retention
We will retain your personal data for as long as necessary to fulfill the purposes we collected it for, including for the purpose of satisfying any legal, accounting, or reporting requirements. We may retain your personal data for a longer period if you make a complaint under this privacy policy or our terms and conditions, or if we have a reasonable belief that litigation may arise concerning our relationship with you. Additionally, we may be required to retain certain personal data to comply with legal and regulatory requirements.

13. Your Legal Rights
Under certain circumstances, you have the following rights under data protection laws in relation to your personal data:
– Request Access: You can request access to your personal data (commonly known as a “data subject access request”). This allows you to receive a copy of the personal data we hold about you and check that we are lawfully processing it.
– Right to Be Informed: You have the right to be informed about how your personal data will be used. This privacy policy, along with any additional information or notice provided to you either at the time you provided your details or otherwise, is intended to provide you with this information.
– Request Correction: You can request the correction of any incomplete or inaccurate personal data we hold about you. We may need to verify the accuracy of the new data you provide to us.
– Request Erasure: You can request the deletion or removal of your personal data where there is no valid reason for us to continue processing it. You also have the right to request the deletion or removal of your personal data if you have successfully exercised your right to object to processing (see below), if we have processed your information unlawfully, or if we are required to erase your personal data to comply with local law. Note that we may not always be able to comply with your request for erasure for specific legal reasons, which will be communicated to you, if applicable, at the time of your request.
– Object to Processing: You can object to the processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your specific situation that makes you want to object to processing on this ground, as you feel it impacts your fundamental rights and freedoms. You also have the right to object if we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
– Request Restriction of Processing: You can request that we suspend the processing of your personal data in the following scenarios:
– If you want us to establish the data’s accuracy;
– Where our use of the data is unlawful but you do not want us to erase it;
– Where you need us to hold the data even if we no longer require it, as you need it to establish, exercise, or defend legal claims; or
– You have objected to our use of your data, but we need to verify whether we have overriding legitimate grounds to use it.
– Request Data Transfer: You can request the transfer of your personal data to you or to a third party. We will provide your personal data in a structured, commonly used, machine-readable format. This right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
– Withdraw Consent: You can withdraw your consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.
If you would like to exercise any of these rights, please contact us (see contact details in paragraph 3 above) and:
– Provide sufficient information to identify you;
– Provide proof of your identity and address (a copy of your driving license or passport and a recent utility or credit card bill); and
– Specify which right you want to exercise and the information to which your request relates.
We try to respond to all legitimate requests within one month. Occasionally, it could take us longer than a month if your request is particularly complex or if you have made multiple requests. In this case, we will notify you and keep you updated.

This cookies policy explains how Gondwana uses cookies and other tracking technologies on the Application. This cookies policy should be read alongside our privacy policy above, which explains how we use personal information.
1. What Are Web Cookies?

They contain details of your browsing history on that website and distinguish you from other users. Cookies send data back to the originating website on each subsequent visit or allow another website or app to recognize the cookie.
